URGENT HELP IS NEEDED!
KSRA, along with several other State Associations have determined that we must work together to file an Amicus Brief to bring a case before the United States Supreme Court to obtain a decision that the Second Amendment right to bear arms applies to the individual States. In the case of Heller v D.C. last year, Justice Scalia's opinion stated that the decision did NOT resolve the separate question of whether the Second Amendment applies to state and local governments.
Please read the article below, "The State of Heller" to fully understand why the decision to file this Amicus Brief became necessary.
Our unity in the protection of the second amendment is critical and we must get this resolved before President Obama stacks the high court with anti-gun judges giving us no chance to resolve this issue once and for all, and in fact, risk a decision that would devastate our rights. There has never been a more important time for State Associations such as KSRA to stand up and fight and insist that the Second Amendment be upheld in it's purest meaning. The KSRA and all other State Associations need the financial support of it's membership, and even those who are not members, in order to do the work that must be done. I make this appeal with the truest sense of urgency!

The State of Heller
Does the Second Amendment apply to state and local governments? The Supreme Court has not definitively ruled, but in Nordyke v. King, decided just before this issue of America’s 1st Freedom went to press, the Ninth Circuit Court of Appeals ruled that the Second Amendment does bind state and local governments. The Ninth Circuit covers the nine westernmost states, including California.
Most laymen, and quite a few lawyers, too, are surprised to find out that the Bill of Rights does not automatically apply to state and local governments. There’s a long and complicated history behind this, but here’s the bottom line:
All of the provisions of the Bill of Rights are direct restrictions on the federal government. Likewise, directly limited is an entity whose powers exist only because they were granted from the federal government. For example, under the Constitution, the federal government is in charge of the District of Columbia. The D.C. Council’s powers exist solely because Congress delegated to the Council some of Congress’ authority over the District.

The President's Corner - July 2009

Greetings KSRA Members!
I’m happy to be back with you starting my second year as President. I want to thank all of you for the faith and confidence you have bestowed upon me with your vote to re-elect me and I will continue to work hard to serve you. I also want to thank all of you who have taken the time to write personal notes to me thanking me and complimenting me on my work. It is because of you all that I so enjoy being part of this great organization.
We’ve made major progress this past year. I’m just thrilled to report that we have well over doubled our membership and it’s growing literally every day. Keep passing the word and recruiting new members. It’s all about the numbers when we try to wield our power with the legislature and we have lots of work we want to do in the 2010 session in Topeka.

Kansas: State Right to Keep and Bear Arms Amendment Passes House, Will be Placed on 2010 Ballot!

On Thursday, March 26, Senate Concurrent Resolution No. 1611 passed out of the Kansas State House by a vote of 116 to 9. SCR 1611, sponsored by State Senator Mike Petersen (R-28), is a constitutional amendment that would change the wording of Section 4 of the Kansas Constitution to specifically preserve and reflect an individual Right to Keep and Bear Arms, not a collective right. SCR 1611 will now be put on the 2010 General Election Ballot.

Please review these legislative initiatives and be sure to contact your U.S. Representative at (202) 225-3121, and your U.S. Senators at (202) 224-3121, and urge them to cosponsor and support these measures. Additional contact information can be found using the "Write Your Representatives" feature at www.NRAILA.org.
• S. 941/H.R. 2296-- the "Bureau of Alcohol, Tobacco, Firearms and Explosives Reform and Firearms Modernization Act." This bill would roll back unnecessary restrictions, correct errors, and codify longstanding congressional policies in the firearms arena. These bipartisan bills are a vital step to modernize and improve BATFE operations. Of highest importance, S. 941 and H.R. 2296 totally rewrite the system of administrative penalties for licensed dealers, manufacturers and importers of firearms.
